Terms of Service

1. Nature and Scope of Services

1.1 Services Provided

Aurelin Medical provides non-emergency, non-surgical medical care through virtual platforms, including but not limited to:

  • Virtual Urgent Care for common illnesses and non-life-threatening medical concerns.

  • Medical Weight Loss Programs that may include nutrition counseling, lifestyle interventions, laboratory testing, prescription medications (including but not limited to GLP-1 receptor agonists), and ongoing follow-up.

1.2 No Emergency Services

Aurelin Medical does not provide emergency or hospital-based services. If you believe you are experiencing a medical emergency, call 911 immediately or go to the nearest emergency department.

1.3  No Guarantee of Outcome

While we provide evidence-based care, Aurelin Medical does not guarantee weight loss, health outcomes, or symptom resolution. Results vary depending on individual health factors, adherence, and external circumstances.

 

2. Provider-Patient Relationship

2.1 Establishment of Relationship

A provider-patient relationship is only established when:

  • You complete the intake and consent forms truthfully and accurately.

  • You participate in a telehealth encounter with a licensed Aurelin Medical provider.

  • The provider determines, at their sole professional discretion, that telehealth services are appropriate for your condition.

 

2.2 Right to Decline or Terminate Care

Aurelin Medical and its providers reserve the right to:

  • Decline to provide services if telehealth is deemed inappropriate.

  • Refer you for in-person care when necessary.

  • Discontinue care for non-compliance, misuse of services, inappropriate conduct, or failure to pay fees.

 

3. Patient Representations and Warranties

By using our Services, you represent and warrant that:

  1. You are at least 18 years of age, or you are the legal parent/guardian of a minor receiving care.

  2. You are physically present in a state where Aurelin Medical providers are licensed at the time of service.

  3. You will provide accurate, complete, and current health and personal information.

  4. You will not misrepresent symptoms, conditions, or history to obtain care or medications.

  5. You will not use Services for unlawful purposes, including diversion of medications.

  6. You will comply with all instructions, follow-up, and recommendations provided by Aurelin Medical providers.

 

4. Consent to Telehealth

By using Aurelin Medical Services, you consent to medical care delivered via telehealth, which may include: video, audio, secure messaging, digital records, or other electronic communications.

 

4.1 Risks of Telehealth

You acknowledge that telehealth:

  • May have limitations compared to in-person visits.

  • May result in incomplete or delayed diagnoses due to technology limitations.

  • May require referral for in-person evaluation.

  • May be subject to technical failures beyond Aurelin Medical’s control.

 

4.2 Informed Consent

You understand and accept these limitations and consent to the use of telehealth technologies for your care.

 

5. Payments, Fees, and Billing

5.1 Payment Terms

  • Services are billed as self-pay, subscription, or through insurance (if accepted).

  • You agree to pay all applicable fees, co-pays, deductibles, and non-covered charges.

  • Payment is due at the time of service unless otherwise arranged.

5.2 Insurance Disclaimer

  • If using insurance, you remain responsible for verifying coverage.

  • Aurelin Medical makes no guarantee of reimbursement.

5.3 Collections and Non-Payment

  • Failure to pay may result in suspension of services, late fees, and referral to collections.

  • You agree to reimburse Aurelin Medical for reasonable attorney’s fees and collection costs incurred.

 

6. Prescriptions and Medication Use

6.1 Provider Discretion

  • Medications, including weight loss agents, will only be prescribed if deemed medically appropriate.

  • Controlled substances will not be prescribed except in compliance with federal and state law.

6.2 Patient Responsibilities

  • You agree to use prescriptions only as directed and not to share them with others.

  • You acknowledge that medication misuse can result in termination of services and possible legal action.

6.3 Pharmacy Disclaimer

  • Aurelin Medical is not responsible for delays, shortages, pricing, or dispensing errors at pharmacies.

 

7. Privacy and Confidentiality

  • Aurelin Medical complies with HIPAA and applicable state laws.

  • While we take all reasonable precautions, no system is 100% secure. You acknowledge the inherent risks of electronic communications.

 

8. Limitation of Liability

To the maximum extent permitted by law:

  • Aurelin Medical is not liable for indirect, incidental, consequential, punitive, or exemplary damages.

  • Aurelin Medical is not liable for delays, interruptions, or failures caused by technology or third-party vendors.

  • Aurelin Medical is not responsible for health outcomes based on incomplete or inaccurate information provided by you.

Total liability shall not exceed the amount paid for the specific service in question.

 

9. Indemnification

You agree to indemnify, defend, and hold harmless Aurelin Medical, its providers, employees, contractors, affiliates, and partners from any claims, damages, liabilities, and expenses (including legal fees) arising from:

  • Your use or misuse of Services.

  • Your breach of these Terms.

  • Your violation of applicable law.

 

10. Intellectual Property

  • All website content, branding, graphics, and software are the property of Aurelin Medical.

  • Unauthorized copying, distribution, or derivative use is strictly prohibited.

16. No Refund Policy

16.1 All Sales Are Final

All payments made to Aurelin Medical for Services, including but not limited to virtual urgent care visits, medical weight loss programs, consultations, subscriptions, membership fees, and administrative charges, are final and non-refundable.

 

16.2 Services Rendered

  • Once a telehealth visit has begun or a consultation has been provided, the fee for that service is earned in full, regardless of outcome, treatment decision, or patient satisfaction.

  • Provider time, expertise, and medical decision-making are considered services rendered even if no prescription is issued, no treatment is provided, or the patient disagrees with the medical recommendations.

16.3 Subscriptions and Memberships

  • Subscriptions and memberships are billed in advance.

  • Payments are non-refundable, including for partial months or unused services.

  • Cancellation of a subscription prevents future billing but does not entitle the patient to a refund for prior payments.

 

16.4 Medications, Labs, and Third-Party Services

  • Fees for prescriptions, compounded medications, injections, or other pharmacy products are non-refundable, even if treatment is discontinued.

  • Laboratory fees, diagnostic testing fees, and any third-party services ordered through Aurelin Medical are non-refundable once ordered.

 

16.5 No Guarantee of Outcome

  • You acknowledge that weight loss, wellness, and medical results vary by individual and that Aurelin Medical makes no guarantee of specific outcomes. Dissatisfaction with results does not entitle you to a refund.

 

16.6 Discretionary Exceptions

  • Aurelin Medical may, at its sole discretion, issue a partial or full refund in extraordinary circumstances (e.g., duplicate billing). Such exceptions do not constitute a waiver of this No Refund Policy and shall not be interpreted as establishing a course of conduct.

 

16.7 Binding Agreement

By using our Services and submitting payment, you acknowledge and agree that this No Refund Policy is legally binding and enforceable to the maximum extent permitted by law.
